Frye
Island Property to be Transferred
to the Town of Frye Island as Deeded Conservation Land
A) Introduction ― The Conservation Commission created by the Town of Frye Island has made two recommendations to the Frye Island Incorporated Board of Directors to transfer some FII property into conservation land. The first recommendation was made in September, 2003 and approved by the FII Board on September 23, 2003. The second recommendation was made to the Board at their August 6, 2004 meeting. It was not clear to the Board what the overall picture was and how the new recommendation was coupled into the previous recommendation. The Board voted to have Joe Potts (FII President) and Ed Charrette (Conservation Commission Chairman) to work together to develop a prioritized listing of areas ready for the transfer into permanent green space. The document resulting from Potts/Charrette interaction was presented to the FII Board at their August 26, 2004 meeting. The FII Board reviewed and approved the document with some changes. The following paragraphs detail the approved results.
B) Conservation Area Blocks ― A version of the Town of Frye Island Land Use map that has been marked to show where the land is that was approved for conservation land -- Small Map, Large Map. The proposed conservation land is shown in a “hot pink” color. The following paragraphs describe the blocks of land being recommended for conservation land and are listed in priority order. The lot numbers shown in bold font are lots that were approved by the FII Board in 2003 to be turned into conservation land. There are total of 131 lots and 8 blocks of land included in the complete list.
1) Retention Pond (41 lots): This interior land is between Birch Road and Harbor Road, just East of the Quail Circle area. Most of this land is continually wet and has a center area that is a pond much of the year. It contains the following lots:
a) Birch Road – 1505, 1506, 1507, 1508, 1519 & 1520
b) Birch Road (Critical Tupelo Area) – 1279, 1509, 1510, 1511, 1512, 1513, 1514, 1515, 1516, 1517 & 1518
c) Pine Circle – 1521, 1527, 1530 & 1531
d) Harbor Lane – 1532, 1533 &1534
e) Harbor Road – 1536, 1537, 1538, 1539, 1540, 1541, 1542, 1543, 1544, 1546, 1547, 1548, 1549, 1550 & 1551
f) Leisure Lane – 336 & 339
2) Resource Protection Area (6 lots): This waterfront land is on Ridge Road on the Southeast portion of the Island, just South of Beach 11. It contains the following lots:
a) Ridge Road – 1607, 1608, 1609, 1610, 1611 & 1612
3) Long Beach Buffer Area (19 lots & 2 blocks of land) : This interior land is North & East of the Long Beach marina. On some maps it is designated “Water-front Commercial” property. Much of the land is wet and there are several small ponds. The land that has been used to launch the Town of Frye Island July 4th fireworks display will continue to be an allowed activity on the conservation land. It contains the following lots (the lots on Birch Road are the lots that had to be put into conservation as a result of the construction of the Long Beach Marina):
a) Long Beach Causeway – Large block of land North and East of Causeway
b) Access Drive off Ridge Road – Small block of land North of lot 508 and West of access drive
c) Birch Road – 1362, 1363, 1364, 1365, 1366, 1367, 1368, 1369, 1370, 1371, 1372, 1373, 1374, 1375, 1376, 1377, 1378, 1379 & 1380
4) Quail Circle Area (14 lots & 1 block of land): This waterfront land is on the West side of the Island, on a large inlet of water. Some of the area is currently being used to dock boats for Island property owners; that usage will continue by an explicit grandfathering clause in the covenant. It contains the following lots:
a) Island Road – 230, 231, 232, 235 & 236
b) Quail Circle –1500, 1501, 1502, 1503, 1556 & 1557
c) Leisure Lane – 226, 227, 228 & block of land South of lot 228
5) West Central Watershed Area (17 lots): This interior land is a major watershed that feeds into the Beach 6 & 7 area on the Western side of the Island. A trail is planned to connect South Beach Road to the Community Center. The land is very wet. It contains the following lots:
a) Lower South Beach Road – 1070, 1071, 1072, 1073, 1156 & 1158
b) Middle Beach Road – 1041, 1042, 1043, 1062, 1063, 1064, 1065 & 1067
c) North Beach Road – 1077 & 1078
d) Leisure Lane – 309
6) Southeast Watershed Area (8 lots): This waterfront and interior land is in the Twin View Circle and Ridge Road area on the Southeast part of the Island. Much of the land is very wet. It contains the following lots:
a) Twin View Circle – 1773, 1796, 1797, 1798 & 1799
b) Ridge Road – 1801, 1802 & 1803
7) Northeast Watershed Area (2 lots): This is interior land on Leisure Lane directly across from Beach 2 on the Northeast part of the Island. Much of the land is very wet. It contains the following lots:
a) Leisure Lane – 103 & 104
8) Leisure Lane West Central (10 lots): This is interior land on Leisure Lane directly North of Birch Road. This is land below the Western bluff, much of which is wet. The goal is to provide a contiguous green space to protect the bluff. It contains the following lots:
a) Leisure Lane – 321, 322, 324, 325, 326, 327, 328, 329, 330 & 332
9) Trail Access Points (4 lots): This is interior land on Ridge Road and provides access area for foot trails to the undeveloped portion of the golf course (the back nine). It contains the following lots:
a) Ridge Road – 1696, 1830, 1885 & 1886
10) Ball Field Conservation (10 lots & 5 blocks of land): The permitting process when the ball field was being developed required some land be placed into conservation. It is included in this report for consistency. It contains the following lots:
a) Leisure Lane – 128, 131, 132, 133 & 137
b)
Beachview –
804, 805, 807, the Picnic & Barbeque Area, the Playground Area, and the two
nearby Saddle Club Riding Areas
Note: There is a septic system in the Western Saddle Club Riding Area,
and access
for maintenance and repair is to be allowed.
c) Paddock Lane – 919, 926 & un-numbered lot between 925/926
C) Deed Covenant Wording ― The following paragraphs describe the points to be included in the deed covenants of the land that is to be transferred to the Town of Frye Island as deeded conservation land.
1) No tree cutting will be allowed.
2) No construction of any kind of building will be allowed.
3) Use of motorized vehicles is not allowed at anytime.
4) No storage of any vehicles, trailers, boats, etc. will be allowed.
5) A foot trail no wider than 4 feet can be constructed, but only after written authority is given by Conservation Commission of the Town of Frye Island.
6) The area between Quail Circle and Island Road can continue to be used for docking boats, related parking of vehicles and access to those docks (i.e. lots 230, 231, 232, 235, 236, 1500, 1556 and 1557) as a part of the Yacht Club operation of the Town of Frye Island.
7) The area East of the Long Beach area that has been used to launch the Town of Frye Island fireworks display will continued to be allowed in the conservation land area.
8) Parking spaces adjacent to a Town road can be created with the recommendation of the Conservation Commission and the approval at least five members of the Executive Committee at a meeting that was called with that purpose, showing on the meeting agenda posted a minimum of seven days in advance.
9) The covenants associated with these dedicated conservation lots will be enforced by the Executive Committee of the Town of Frye Island. The Town should establish specific fines associated with breaking the covenants.
10) If the Town of Frye Island ceases to exist at any time in the future, all of this property will be returned to Frye Island Incorporated at no cost.
11) Exceptions and amendments to these covenants can be made, if recommended by a majority of the Executive Committee and approved by a two-thirds majority vote of the Board of Island Trustees at one of their meetings that was called with that purpose, showing on the meeting agenda posted a minimum of seven days in advance.
Since this request for the land came from the Conservation Commission of the Town of Frye Island, all of the costs to complete the transfer of FII land into conservation should be paid by the Town of Frye Island.
