Town Meeting Warrant
Explanation of Articles presented by the Planning Board


The Town of Frye Island Planning Board presents these articles for action by the voters of Frye Island:  (The Article numbers match those on the October 2001 Warrant.)
Article 8 presents to the voters a completely revised and edited version of Chapter 101, Land Use Ordinance.  Care has been taken not to change the Chapter's meaning.  An explanation of what was done, along with the unedited and edited versions can be found in the Town Office, and on the Town Web Page.
In carrying out the above editing task, a number of defects were found in the Chapter 101 text that seemed to scream for correction. These corrections were not made to the newly edited Chapter 101, since such edits would have changed the meaning of ordinance. Rather, these proposed corrections are presented as separate items to be voted on in Articles 9 through 12.
Article 9 changes the definition of Adult Day Care for three (3) or fewer unrelated adults who are medically dependent on others for assistance.  It also makes it clearer that care for more than three unrelated adults is not an allowed use.
Article 10 changes the definition of Conforming Lot. Our current Land Use Ordinance allows use variances on a non-conforming lot, but not on a conforming lot. (Note: most lots on Frye Island are non-conforming.)
Article 11 deletes the special setback distances for manufactured housing units located outside mobile home parks.  They are then subject to the same street setback restrictions as other dwelling units (currently fifty feet in all districts).
Article 12 allows certain types of small signs without a permit. Currently, our current ordinance requires permits, although this is not enforced.
Article 13 eliminates campgrounds as an allowed use in any district in the Town of Frye Island.
Article 14 changes the minimum frontage dimension in a Residential District from 100 feet to 50 feet.  This eliminates the need for special consideration on cul-de-sacs and places where the road curves.  Most lots on Frye Island have a frontage between 50 and 80 feet.
Article 15 changes the definition of Building Height to one more easily understood, and one that meets the requirements of the Town Fire Department.
Article 16 adds a new Ordinance titled "Home Numbering Requirements".  The Fire Department has requested that every house on the Island have a sign with a house number.
Article 17 adds a penalty for not registering a golf cart.
