Executive Committee Meeting Minutes

This meeting immediately followed a workshop to gather information on 12 proposed changes to the Town of Frye Island Charter. A listing of those twelve items and a list of attendees at the workshop are provided in the attachment to these minutes.

General Discussion of workshop comments pertaining to Charter revision suggestions.

1.	Article III, Section1 Motion made by John to go from 3 selectmen to 5 selectmen, second by Oleg Amendment by Dick, second by John, to increase selectmen by 2 and Board of Island Trustees by 2, once Town has 500 registered voters. Amendment failed unanimous against; Motion failed 1 Yes (John); 5 No
2.	Motion by Joe, second by John; that no more then 1 person from an immediate family can serve on Executive Committee or Board of Island Trustees. Amendment should be made to Article 6G Motion Failed 5 No; 1 Yes (John)
3.	Article III, Section 6A Motion made by John, Mark second, to amend above fore mentioned article to that Register of Voters, Tax Collector, Town Treasurer, and Town Clerk should be elected, not appointed. Motion Failed 5 No; 1 Yes (John)
4.	Article III, Section 6C Motion made by John, second by Mark, to amend above fore mentioned Article so that the hiring of a general Town Attorney through a qualification based selection process. Amendment would be added to end of Article III, Section 6C. Motion passed 5 Yes; 1 No (Mark)
5.	Article IV, Section 3 Motion by Mark, second by Jim, to amend above fore mentioned Articles. Town will operate an early ferry for education of children. The Charter should require ferry service, for regularly scheduled school hours, to transport school children off and on the Island. Motion failed 5 No; 1 Yes (John)
6.	Article V, Section 3-1 Motion by Jim, second by John, to amend above fore mentioned article so that the Charter should set limits on what funds the Town can spend without a bid process. Motion failed 3 No; 2 Yes (John & Dick)
7.	Motion by Joe, second by Dick, that Executive Committee take action to draw a warrant article to define limits that the Town can spend without a bid process. Motion passed unanimously
8.	Article VI, Section 1A Jim motioned, John second to amend above fore mentioned Article to allow landowners to vote at Board of Island Trustees meeting. Present Charter doesn't allow landowners to vote when they represent the largest block of people on the Island. Motion Failed 3 Yes (John, Jim, Dick); 3 No (Joe, Mark, Oleg) (motion failed because a majority of Selectmen voted in negative)
9.	Article VI, Section 1-I John motioned, second by Mark, to amend above fore mentioned Article so that the positions of Planning Board, Board of Appeals, and Budget Committee should be elected by Town voters; not appointed. Motion failed 1 Yes (John); 5 No
10.	Motion by Joe, second by Mark; that conflict between Article VI, Section 2, and Article VI, Section 1-I, be resolved by indication that the Board of Selectmen is the appointing body. This would be an amendment to above fore mentioned Articles in the Charter. Motion passed unanimously
11.	Article VIII, Section 1 Motion by Mark, second by Dick, that "the Executive Committee", in line 3 be deleted and that the Board of Island Trustees be inserted instead. This would be an amendment to above fore mentioned Article. Motion passed unanimously
12.	Motion by Joe, second by Dick to have Town Manager contact the Maine Municipal Association to discover recent ruling on recall of Municipal Officers. Motion passed unanimously
13.	Motion by Joe, second by Dick, to have Town Manager and appropriate Town Officials to establish an Ordinance for no discharge of firearms or lethal trapping on Frye Island. The following may be authorized by the Board of Selectmen: hunting to call the deer herd or other animals to protect citizen safety, from rabid animals; humane trapping to relocate animals; and, discharge of firearms by law enforcement officers in the performance of their duties. Motion passed unanimously.
14.	Mark motioned, Dick second, that the suggestion that Island residents be given preference in hiring, if qualified and that job openings be posted for 7 days not be added to Charter, but that consideration be given to adding to Town's policy manual. Motion passed 5 Yes; 1 No (John)
15.	Mark motioned, Jim second to adjourn at 8:15 PM Motion passed unanimously

1. Article III, Section 1; There should be 5 Selectmen, Instead of 3, to give a better cross section of the Island, No more than one person from an immediate family can serve on the Board of Selectmen.

2. Article III, Section 6-A; These Town officials should be elected, not appointed, to give voters a say in these positions.

3. Article III, Section 6-C; The hiring of a Town attorney should be a sealed bid process as a matter if fiscal responsibility.

4. Article IV, Section 3: The Town operates an early ferry for workers but will not operate a ferry for education of children. The charter should require ferry service, for regularly scheduled school hours, to transport school children off and on the Island.

5. Article V, Section 3-J: The charter should set a ,limit on what funds the Town can spend without a bid process.

6. Article VI, Section 1-A; Does not allow land owners to vote when they represent the largest block of people on the Island. This should be changed to allow land owners a vote.

7. Article VI, Section 1-I; These positions, (Planning Board, Board of Appeals and Budget Committee), should be elected, not appointed, to give voters a say.

8. Article VI, Section 2; Conflicts with Article VI, Section 1-I about how members are appointed to various boards.

9. Article VIII, Section 1; The rates for the ferry service should be set by the voters, as it always has been, not by the Executive Committee.

1. Additionally, there are no provisions in this charter for the recall of Municipal Officers. The charter should enumerate reasons for recalling Municipal Officials and the procedure to do it.

2. No discharge of firearms, no hunting or lethal trapping is allowed in the Town of Frye Island. The following may be authorized by the Board of Selectmen; hunting to cull the deer herd or other animals to protect citizen safety from rabid animals, humane trapping to relocate animals and by law enforcement officers in the performance of their duties.

3. Island residents will be given job preference in hiring, if qualified. All job openings are to be posted for 14 days at the Town office.
